1. Introduction

This Privacy Policy (the “Policy”) is issued by Spectrum Design & Drafting Studios Ltd.(“Spectrum Home Plans,” “we,” “us,” or “our”) and governs the collection, use, disclosure, and retention of personal information in connection with the website located at spectrumhomeplans.com and any related online services we operate (collectively, the “Site”).

We comply with applicable Canadian federal and provincial privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and, where applicable, the laws of the Province of Alberta.

Access to and use of the Site constitutes acknowledgement of this Policy. If you do not agree with this Policy, you must not use the Site or submit personal information to us.

2. Scope

This Policy applies solely to personal information collected by us through the Site or otherwise in the course of providing our products and services. The Site may contain links to third-party websites or services, including authentication and payment interfaces operated by our service providers. We are not responsible for the privacy practices of any third party. The collection and use of information by such third parties are governed by their respective privacy policies.

Registration is not required to browse publicly available portions of the Site. Personal information is collected only where reasonably necessary to provide a requested product or service, to operate the Site, or as otherwise permitted or required by law.

3. Personal Information

For the purposes of this Policy, “personal information” means information about an identifiable individual, including, without limitation, name, email address, telephone number, billing information, and account identifiers.

4. Information Collected

We may collect the following categories of personal information:

4.1 Account information

If you create or access an account, our authentication provider, Clerk, processes account credentials and related identifiers, which may include your name, email address, and authentication tokens, for the purpose of establishing and maintaining your session.

4.2 Transaction information

If you purchase a plan, we record the products purchased, quantities, and transaction amounts. Payment card processing is performed by Stripe. We do not store complete payment card numbers on our systems.

4.3 Device-stored preferences

Shopping-cart contents and saved-plan selections may be stored locally in your browser. Such information is not transmitted to us except as required to complete a checkout request initiated by you.

4.4 Communications

If you contact us by email, telephone, or other means, we collect the information you elect to provide, which may include contact details and information concerning your inquiry or project.

4.5 Content hosted for publication

Images and documents published as catalogue content are hosted by our file-storage provider. Such materials constitute business content and are not customer account records.

We do not collect personal information through advertising technologies, analytics or tracking pixels, session-replay software, contests, surveys, or similar marketing instruments on the Site.

5. Purposes of Collection and Use

Personal information is collected and used only for purposes that a reasonable person would consider appropriate in the circumstances, including to:

  • operate, maintain, and secure the Site;
  • authenticate users and administer accounts;
  • process transactions and fulfill orders;
  • respond to inquiries and provide customer support;
  • maintain business, tax, and accounting records;
  • detect, prevent, and investigate fraud, abuse, or security incidents; and
  • comply with legal, regulatory, and contractual obligations.

We do not use personal information for promotional or marketing communications except where you have provided consent or where such use is otherwise permitted by law.

We do not sell personal information.

6. Cookies and Local Storage

The Site uses cookies and local storage solely where necessary for the operation of the Site. Clerk may set session cookies required for authentication. The Site may use local storage to retain cart contents and saved-plan selections on your device.

The Site does not deploy cookies or similar technologies for advertising, cross-site tracking, or analytics.

You may disable cookies in your browser. Doing so may impair or prevent authentication, checkout, and other functions of the Site.

7. Disclosure to Service Providers and Other Parties

We may disclose personal information to service providers that perform services on our behalf, solely as required for those services, including:

  • Clerk, for identity and session management;
  • Stripe, for payment processing;
  • UploadThing, for hosting of published media files; and
  • providers of website hosting, infrastructure, and data storage.

Certain service providers may store or process personal information outside Canada. Information transferred outside Canada may be subject to the laws of the jurisdiction in which it is held, including lawful access by foreign governmental authorities.

We may also disclose personal information where required or permitted by law, including in response to a warrant, subpoena, court order, or other lawful request; to establish, exercise, or defend legal claims; or to protect the rights, property, or safety of Spectrum Home Plans, our customers, or others.

8. Retention

Personal information is retained only as long as necessary to fulfill the purposes for which it was collected, including account administration, order fulfillment, customer support, and compliance with legal, tax, and accounting requirements, or as otherwise required or permitted by law.

Information stored locally in your browser is retained until you delete it or clear the relevant browser data.

Upon request, we will delete or correct personal information under our control, subject to any legal obligation or legitimate business requirement to retain it.

9. Safeguards

We implement physical, organizational, and technical safeguards appropriate to the sensitivity of the personal information in our custody. Access is limited to personnel and service providers who require such access to perform their duties.

No method of transmission or storage is completely secure. We cannot guarantee absolute security of personal information.

10. Children

The Site is intended for persons seeking residential design plans in a commercial context. The Site is not directed to children, and we do not knowingly collect personal information from children.

11. Access, Correction, and Withdrawal of Consent

Subject to limited exceptions under applicable law, you may request access to, or correction of, personal information we hold about you. Where we rely on consent, you may withdraw that consent, subject to legal or contractual restrictions and reasonable notice. Withdrawal of consent may affect our ability to provide certain products or services.

You may also lodge a complaint with the Office of the Privacy Commissioner of Canada or the Office of the Information and Privacy Commissioner of Alberta.

12. Changes to this Policy

We may amend this Policy from time to time. The revised Policy will be posted on this page and will indicate the effective date. Your continued use of the Site following the posting of changes constitutes acceptance of the revised Policy.
